ANJANA MISHRA ORAL ORDER 17-08-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 323/379/406 of the Indian Penal Code.

Learned counsel for the petitioners submits that the allegation as made out by the complainant is false and mischievous and there is no occasion for the complainant to give twenty thousand rupees for having handing over the same to his father. He further submits that petitioners have been implicated falsely only because of the fact that there was Panchayati between the parties which had failed and thus the present case has been lodged.

Considering the aforementioned fact and circumstance and

Patna High Court Cr.Misc. No.32340 of 2015 (2) dt.17-08-2015 P2/2 the vagueness of the allegation made against the petitioners and also the fact that the petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Araria, in connection with Complaint Case No. 2202 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
