The petitioner apprehends his arrest in Chand P.S. Case No.112 of 2019 registered under Sections 279, 337, 338, 307, 353 and 34 of the Indian Penal Code.

The informant alleged that the petitioner was driving motorcycle and dashed a SAP constable causing fracture injury on his leg and injury on his head.

The learned counsel for the petitioner submits that petitioner was also badly injured in the accident. It is a pure case of motor accident and not the intentional dashing knocking constable from the motorcycle but it appears from the contents of the F.I.R. itself that petitioner being the driver of the motorcycle on being signaled to stop sped up his motorcycle

Patna High Court CR. MISC. No.54484 of 2019(2) dt.30-08-2019 2/2 and dashed SAP constable causing fracture injury on his leg and injury on his head. During the course of investigation, it appears from the order of the learned Sessions Judge that the witnesses have disclosed that it was petitioner who was driving the motorcycle.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
