JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Complaint Case No. C-68(7) of 2016 of Murliganj Police Station under Section 47(a) of Bihar Excise (Amendment) Act, 2016. Allegedly, from the house of the petitioner and his brother 76 pieces of bottles each containing 180 ml. of foreign liquor were recovered i.e. total 13.680 liter and the petitioner is in custody since 19.06.2016.

In the facts and circumstances stated above, considering the detention of the petitioner, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount to the satisfaction of the Learned Chief Judicial Magistrate,

No.41821 of 2016 (2) dt.06-10-2016 2/2 Madhepura in connection with Complaint Case No. C-68 (7) of 2016 of Murliganj Police Statino, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
