====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-12-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with K. Hat P.S. Case No. 835 of 2018 for the offence registered under Sections 306/34 of the Indian Penal Code. The allegation is regarding the accused persons having created such a situation which had led to the victim deceased lady committing suicide and the accused persons are said to have abetted the commission of suicide by the victim lady.

The learned counsel for the petitioner has submitted that though the petitioner is husband of the deceased lady but the fact is that the petitioner was married with the deceased lady 18 years back and out of the wedlock, three daughters are there

Patna High Court CR. MISC. No.63330 of 2019(4) dt.04-12-2019 2/2 who are staying his village home along with his father. It is further submitted that the petitioner is staying at Noida (U.P.) and working there for his livelihood and there is no possibility of the petitioner having abetted the commission of suicide by the deceased victim lady. It is also submitted that the petitioner is having a clean antecedent. Lastly, it is submitted that the petitioner undertakes to maintain and keep his daughters with dignity.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on anticipatory bail in the event of his arrest/surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnia in connection with K. Hat P.S. Case No. 835 of 2018 subject to the conditions as stipulated under Section 438(2) of the Code of Criminal Procedure.
