Case No. 34 of 2016 registered under Section 302 and other sections of the Indian Penal Code.
The father of the deceased alleged that his son had taken wine and the petitioner and his son quarreled with each. The petitioner brutally assaulted the deceased, on account of which, the deceased got many injuries and died after treatment. Learned counsel for the petitioner submits that the deceased had taken wine to the house of the petitioner. There was some quarrel on account of which serious injury was caused to the deceased but from perusal of the post mortem report it appears that the deceased got injury 8 cm x 6 cm on front of left abdomen and adjoining chest lower 08 cm left to midline and 13
Patna High Court Cr.Misc. No.39028 of 2016 (3) dt.21-11-2016 2/2 cm below left nipple. On opening of the abdomen, yellowish green colour fluid was found. On account of such assault, intestinal injuries were caused which developed into Septicemia and the deceased died after two days of the occurrence. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail in Dhanarua P.S. Case No. 34 of 2016 at this stage. Accordingly, the same is rejected.
