Apprehending his arrest in connection with Bahadurpur P.S. Case No. 82 of 2017 (now Special Case No.1009 of 2017) registered for the offences under Sections 38 and 41 of the Bihar Prohibition and Excise Act, 2016, the petitioner has filed the present application under Section 438 of the Code of Criminal Procedure for grant of pre-arrest bail.

After some arguments, learned counsel for the petitioner has sought leave to withdraw the present application in order to surrender before the court below and seek bail in the light
