JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 23-03-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Narpatganj P.S. Case No. 244 of 2022, registered for offence punishable under section 414 of the Indian Penal Code and sections 25 (1-b) a, 26 of the Arms Act.

As per allegation, the police arrested the petitioner at the spot and from his possession, one loaded country-made pistol was recovered.

The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He is under custody since 01.06.2022. On the other hand, Mr. J. N. Thakur, the learned APP

Patna High Court CR. MISC. No.57409 of 2022(3) dt.23-03-2023 2/2 has opposed the prayer for bail and has submitted that the petitioner has criminal antecedent and there are thirteen cases pending against him.

It appears that the petitioner has strong criminal antecedents and as many as thirteen cases are pending against him. As such, he does not deserve the privilege for bail. Accordingly it is rejected.
