2. This petitioner seeks regular bail in connection with Araria (Bairgachhi) P.S. Case No. 28 of 2022 registered under Sections 8, 20(b)(ii)(c), 25, 29 of the N.D.P.S. Act.

3. This is the second attempt of the petitioner for grant of regular bail. Earlier the bail of the petitioner was rejected vide Cr. Misc. No. 42793/2022 dated 04.02.2023. Petitioner is in custody since 11.01.2022.

4. Learned counsel for the petitioner submits that in paragraph 53 and 54 of the case diary, it has come that on getting information about the illness of his father, the petitioner was travelling in car from Assam. Petitioner claims clean antecedent.

5. Considering the clean antecedent, period of

Patna High Court CR. MISC. No.60215 of 2023(4) dt.01-12-2023 2/2 custody and the fact that the petitioner was travelling back home to meet his ill father, this application for regular bail is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Araria/concerned Court below in connection with Araria (Bairgachhi) P.S. Case No. 28 of 2022 subject to condition that:- 6(i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date through his lawyer or himself fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.
