The petitioner apprehends his arrest in connection with Nawada Town P. S. Case No. 176 of 2016 instituted under Sections 419, 420, 467 and 468 of the Indian Penal Code and Section 10 of the Bihar Conduct of Examinations Act, 1981. The allegation, in brief, is that in place of this petitioner, another person appeared impersonating him in the matriculation examination in the year 2016.
Learned counsel for the petitioner submits that offence under the Bihar Conduct of Examinations Act, 1981 is bailable in nature and no forged document was created by this petitioner and he is only a beneficiary and another person had appeared in his place in the examination without his knowledge.
Patna High Court Cr.Misc. No.15288 of 2017 (2) dt.15-06-2017 2/2 Considering the nature of offence, prayer for anticipatory bail of the petitioner is rejected. However, if he surrenders before the court below and seeks regular bail, the same shall be considered on its own merit without being prejudiced by this order.
