JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2018 Heard Mr. Ashok Kumar Chaudhary, learned counsel appearing for the petitioner and the learned counsel appearing for the State.

Mr. Ashok Kumar Chaudhary fairly submits that during the pendency of the writ application petitioner has been paid his salary of arrears. The only controversy is now boiled down to payment of salary for the period of suspension from December, 2016, to July, 2017.

In view of the provisions of the Bihar Service Code Rule, 197, the respondents are required to pass specific order with regard to period of suspension after the suspension is revoked.

Patna High Court CWJC No.14905 of 2016 (2) dt.06-02-2018 2/2 Since the respondents are now required to pass the reasoned order as to how the period of suspension has been treated the present writ application is disposed of with a direction to the respondents 5 and 7 to take final decision with regard to the period of suspension from December, 2016, to July, 2017 for the purpose of payment of salary of the suspension period. Such decision must be taken by the respondents by a reasoned and speaking order within a maximum period of one month, from the date of receipt/production of a copy of this order (Anil Kumar Upadhyay, J) SA/- U
