The petitioner seeks pre-arrest bail in connection with Bisfi (Patouna) P.S. Case No. 129 of 2018 for the offences alleged under Sections 147, 148, 149, 341, 323, 324, 307, 332, 333, 353, 109, 114, 117, 427, 435, 379, 504, 506 and 511 of the Indian Penal Code and 3 of the Damage to Public Property Act. The accusation is that on receiving the information about catching of a person on suspicion of child lifter by the villagers of Vahampura, the informant along with other police personnel reached there and took the person to Police Station, then, mob of 100-150 persons started creating nuisance and damage the Government property and tried to snatch the fire arms of the police personnel. At that time, 32 persons, including the petitioner, were identified.

Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Bisfi (Patouna) P.S. Case No. 129 of 2018 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Madhubani, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
