This is a petition for grant of anticipatory bail for offence under Sections 406 and 420 of the Indian Penal Code and 26(ka) of the Bihar Mines Act.

Allegation against the petitioner is that he was running brick kiln without license.

Submission of the learned counsel for the petitioner is that Annexure 2 series would reveal that prior to the alleged date of search, the petitioner had already applied for license after payment of due fee.

Considering the aforesaid fact, let the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Narari Kala Khurd P.S. Case No. 11 of 2017 to the satisfaction of the Chief Judicial Magistrate, Aurangabad, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
