The petitioner has preferred this application for grant of regular bail in a case registered under sections 379, 411, 413 and 414 of the Indian Penal Code As per the prosecution case, it is stated by the informant that on making enquiries, it transpired that his pumping set had been stolen by the accused persons including the petitioner herein and the said pumping set as also stolen motorcycle was found in the house of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession or his house. He has been falsely implicated in the
Patna High Court CR. MISC. No.67958 of 2021(2) dt.29-04-2022 2/2 case. He is in custody since 6.9.2021 and chargesheet has been submitted in the case.
Having heard learned counsel for the parties and taking into consideration the nature of allegations together with the petitioner having remained in custody for more than 7 months, the Court directs the petitioner to be enlarged on bail in connection with Bettiah Muffasil P.S. Case no.102 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran, Bettiah.
