JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-08-2017 The petitioner seeks regular bail in connection with Sono P.S. Case No. 47 of 2017, registered for offences punishable under Sections 272, 273 of Indian Penal Code and Section 37,41, 47 and 53 of the Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner is of recovery of 810 litres of liquor and he was arrested on chase by the police. It has been submitted on behalf of the petitioner that he has nothing to do with the alleged recovery and he and his wife has falsely been implicated in this case. Further he has clean antecedent and has been in judicial custody since 26.03.2017. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, nature of allegation, this application is

No.35957 of 2017 (2) dt.09-08-2017 disposed of with direction to the court below to release the petitioner on bail to his own satisfaction after completion of six months in judicial custody of the petitioner.
