Mr.Bharat Lal ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-08-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Govindpur P.S. Case No. 63 of 2019, registered under Sections 147, 148, 149, 341, 323, 324, 307, 354(A), 379, 452, 504 and 506 of the Indian Penal Code.

The accusation is that in the morning of 22.04.2019, nine persons named in the F.I.R. including the petitioners armed with iron rod and Khanti entered in the house of informant, Gyatri Devi and caused assault to Lakhan Yadav, Dhananjay

Patna High Court CR. MISC. No.54745 of 2019(2) dt.30-08-2019 2/2 Yadav, Bindu Devi and Ajay Yadav with intention to kill them. At that time, they snatched the earring, gold ornaments from Bindu Devi and took mobile from the pocket of Ajay Yadav. Learned counsel for the petitioners submits that while the petitioners are named in the F.I.R. along with four others but there is general and omnibus allegation made against the all accused persons to cause injury to aforesaid four persons. Moreover, the injuries, as found on the persons of the injured, are simple in nature.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Nawada, in connection with Govindpur P.S. Case No. 63 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
