JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bath P.S. Case No. 15 of 2019 registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 354, 448, 504, 506 of the Indian Penal Code. Allegation against this petitioner is that he tried to outrage the modesty of the informant by tearing her Blouse. Allegation of assault is against other co-accused persons. Submission of the learned counsel for the petitioner is that there is case and counter case between the parties and there is no allegation of assault against this petitioner. Heard learned A.P.P. also.

In view of the above facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on

No.55143 of 2019(2) dt.02-09-2019 2/2 furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M. XIII, Bhagalpur, in connection with Bath P.S. Case No. 15 of 2019 subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
