Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner apprehends his arrest in connection with Dawath P.S. Case No. 99 of 2023 dated 25.06.2023, registered for the offences punishable under Sections 406 and 506 of Indian Penal Code.

The main submissions advanced by learned counsel for petitioner are that the allegation levelled against him in the FIR mainly attracts civil liability as the dispute appearing from the FIR is civil in nature and the main allegation against the petitioner is that he is not willing to return the amount of Rs. 1,25,000/- to the informant.

Learned APP for the State opposes the bail prayer of the

Patna High Court CR. MISC. No.59963 of 2023(2) dt.11-10-2023 2/2 petitioner.

Considering the above submissions and mainly the nature of allegation appearing against the petitioner, this Court is inclined to accept his anticipatory bail prayer. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail in connection with Dawath P.S. Case No. 99 of 2023 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Shailendra Singh, J) Shahnawaz/- U T
