The petitioners apprehend their arrest in connection with Bihiya P.S. Case No. 132 of 2016 registered under Sections 304(B) and 34 of the Indian Penal Code.
The accusation is of killing of grand-daughter of the informant by burn, who had one baby aged about 7 years, for nonfulfillment of demand of motorcycle by her husband and in-laws. Learned counsel appearing on behalf of the petitioners submits that in fact, deceased, grand-daughter of the informant sustained burn injury in course of cooking the food and died. The information regarding the occurrence was given to the
Patna High Court Cr.Misc. No.38962 of 2016 (2) dt.06-10-2016 2/2 informant, but with ulterior motive, the present false case has been lodged. The petitioners are mother-in-law and un-married brotherin-law of the deceased, have falsely been implicated in this case. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-5th, Ara in connection with Bihiya P.S. Case No. 132 of 2016 (G.R. No. 2643 of 2016), subject to the condition as laid down under Section 438(2) of the Cr. P.C.
