The petitioner seeks bail in connection with Sherghati (Dobhi) P. S. Case No. 126 of 2020, instituted for the offences under Sections 147, 341, 323, 504, 506, 325, 307, 379 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 03.09.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

The learned counsel for the petitioner further submits that the informant alleges that on account of dispute relating to vehicle charges the named accused persons including the petitioner came to the house of the informant and on orders of Akal Yadav, accused Shankar Yadav assaulted the informant on head by tangi, Prakash Yadav assaulted the husband of the informant repeatedly by khanti on head, Manoj Yadav assaulted Anil Yadav by rami on head causes injuries and Mahesh Yadav

Patna High Court CR. MISC. No.68016 of 2021(2) dt.12-04-2022 2/2 assaulted Krishna Yadav by an iron rod on head. Learned counsel for the petitioner submits that the petitioner has been falsely implicated, it is submitted that though, the informant has specifically alleged that who assaulted whom and by what weapon but as far as petitioner is concerned there is no allegation against him of assault. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 03.09.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case and there is no specific allegation of assault against the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati (Gaya) in connection with Sherghati (Dobhi) P.S. Case No.126 of 2020.

The application stands allowed.
