JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code.
As per the prosecution case, on 28.04.2021 at about 5 PM husband of the informant left the house along with this petitioner and thereafter she came to know that her husband had been killed by the FIR named accused persons, including this petitioner.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has been implicated in the case only on suspicion.. During the course of the investigation none of the witnesses has stated that this petitioner was seen committing the murder of husband of informant. Save and

Learned counsel appearing for the State opposes the prayer for bail and submits that it is a case of circumstantial evidence and petitioner was last seen with the deceased. Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VIII, Patna in connection with Parsa Bazar PS case No.153/2021.
