The petitioner apprehends his arrest in Gaya Rail (GRPS Gaya) P.S. Case No. 191/2016, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 384, 307, 324, 353 and 504 of the Indian Penal Code and Sections 145 and 147 of the Railways Act.
The informant, police officer, alleged that the staff and owner of two buses at bus parking stand, Gaya indulged into scuffle and they made indiscriminate firing against each other. Learned counsel for the petitioner submits that three cases were registered; first, Gaya Rail P.S. Case No. 191/2016 registered by S.H.O. of Gaya Rail P.S., second, Gaya Rail P.S. Case No. 192/2016 registered by Kamal Kumar and Gaya Rail
Patna High Court Cr.Misc. No.26068 of 2017 (2) dt.07-07-2017 2/2 P.S. Case No. 193/2016 registered by Bijendra Sharma. In all that cases almost same and similar allegations are made. Mannu Sharma @ Monu Sharma has already been granted anticipatory bail vide order 21.12.2016 passed in Cr. Misc. No. 52065/2016 by a co-ordinate bench of this Court and on that ground other accused persons were also granted anticipatory bail vide orders passed in Cr. Misc. No. 46740/2016 and Cr. Misc. No. 47853/2016. Case of the petitioner stands on the same footing.
Considering the facts aforesaid and the fact, the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Gaya in connection with Gaya Rail (GRP) P.S. Case No. 191/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
