The petitioners apprehend their arrest in connection with Muffasil (Singhaul) P.S. Case No. 176 of 2019, registered under Section 307 and allied Sections of the Indian Penal Code. The accusation is that 17 persons named in the F.I.R. including the petitioners came at the door of the informant and with intention to capture the land, started to fix the bamboo and stake at his land. When Mamta Devi, mother of the informant, raised objection then Upendra Yadav (petitioner no.1) gave khanti blow at her head. Thereafter, his father, Rajaram Yadav came to save his mother then Barun Yadav

Patna High Court CR. MISC. No.60931 of 2019(2) dt.26-09-2019 2/2 (petitioner no. 2) gave khanti blow at his head. At that time, Pankan tried to press the neck of sister of the informant and informant was also assaulted by Yogendra Yadav through Khanti.

Learned counsel for the petitioners submits that petitioners are co-villagers of the informant and due to land dispute the present case has been lodged with false allegation. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Begusarai, in connection with Muffasil (Singhaul) P.S. Case No. 176 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
