JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The informant having got confidential information raided the premises of one of the F.I.R named accused Dinesh Mahto and others and arrested the aforesaid F.I.R. named accused Dinesh Mahto and some others and also seized liquor in huge quantity from the premises of aforesaid Dinesh Mahto and while the apprehended co-accused were carrying to the police station, several persons attacked on police party and assaulted them by different weapons.
Submission on behalf of the petitioner is that no overt act has been attributed against him. Learned counsel for the petitioner submitted that prior to institution of the present case,
Patna High Court Cr.Misc. No.40244 of 2016 (2) dt.26-09-2016 2/2 petitioner had not been made accused in any other case and, as a matter of fact, for the same occurrence, two separate cases i.e., Dalsignsarai P.S.Case No. 213 of 2016 as well as present case were lodged against the petitioner.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Samastipur in connection with Dalsingsarai ( Gataho) P.S.Case No. 214 of 2016.
