JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 297, 337 and 307 of the Indian Penal Code.
It is alleged that the petitioner while driving pick-up van, dashed the informant in order to kill him. It is submitted by learned counsel for the petitioner that the injury report suggests three injuries, of which one is swelling, second is lacerated wound and the third is bruise of marginal size. It is further submitted that the accusation has been levelled in the background of litigated relationship. At earlier point of time three cases have been lodged by the informant side against the petitioner in the background of serious land dispute and the only nonbailable offence alleged is under section 307 IPC.
Patna High Court Cr.Misc. No.31908 of 2014 (2) dt.03-02-2015 2/2 Considering the nature of injury, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Siwan(M) P.S. Case No. 173 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
