The prayer is allowed.
This petition stands dismissed as withdrawn so far petitioner no. 1 is concerned.
Heard learned counsel for petitioner nos. 2 to 5 and learned counsel for the State.
The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 341,
Patna High Court Cr.Misc. No.32229 of 2014 (2) dt.21-01-2015 2/3 323, 325, 307 & 504 of IPC.
It is submitted that there has been case and counter case for the same occurrence. Co-accused Ajay Singh has also filed Deo P.S. Case No. 15 of 2014 against the informant and others for the offence punishable under Sections 147, 148, 149, 341, 342, 324, 307, 504, 506 and 379 IPC. The petitioners have no criminal antecedent.
Considering the facts and circumstances, in case of arrest or surrender within a period of four weeks petitioner nos. 2 to 5 will be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in Deo P. S. Case No. 14 of 2014, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure and the other following conditions:-
1. The petitioners will not indulge themselves in similar or any other offence.
2. One of the bailors must be the close relative of the petitioners.
3. The petitioners will be well represented in the Court on each and every date and in case of absence for two
Patna High Court Cr.Misc. No.32229 of 2014 (2) dt.21-01-2015 3/3 consecutive dates or in case of violation of terms of bail, their bail bond would be liable to be cancelled by the learned Court concerned.
