Despite valid service of notice, on repeated calls, nobody appears on behalf of the State.

The petitioners seek pre-arrest bail in connection with Raniganj P. S. Case No. 302 of 2016 registered under Sections 323, 341, 325, 326, 307, 379 and 504/34 of the Indian Penal Code.

Regard being had to the fact that there is case and counter case and there is no allegation in the FIR that the petitioners intended to kill the informant as also the fact that the injury reports of the victim do not disclose that the injuries were

Patna High Court Cr.Misc. No.25185 of 2017 (2) dt.01-07-2017 2/2 grievous in nature, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Araria in Raniganj P. S. Case No. 302 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
