JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-06-2018 Petitioners apprehend their arrest in connection with Khagaul P.S.Case No. 10 of 2017 registered for the offences punishable under Sections 147, 153A, 298, 149 and 436 of the Indian Penal Code.

Allegation against the petitioners and other accused persons is that they have provoked against other community and set the AC of Masjid on fire.

Submission of learned counsel for the petitioners is that there is no specific allegation against any of the petitioners and there is general and omnibus allegation and no injury was caused to anyone during the occurrence.

Having heard both sides and in the facts and circumstances, let the petitioners, named above, surrender within a period of six weeks from the receipt of this order and on their so surrendering they shall be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sri R.N.Singh, Judicial Magistrate, Danapur, in connection with Khagaul P.S.Case No. 10 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
