The petitioners apprehend their arrest in a case registered for the offence under Section 308, 323 and other minor sections of the Indian Penal Code.

As per the prosecution case, on the alleged date and time of occurrence, while the informant was going to Asthawa and reached near a river, all the F.I.R. named accused persons including these petitioners assaulted the informant and two others persons by means of iron rod, as a result of which, they sustained injuries. These two petitioners are alleged to have made indiscriminate firing.

It is submitted on behalf of petitioners that there is case & counter case and both sides sustained injury. Both parties

Patna High Court CR. MISC. No.68707 of 2021(3) dt.16-08-2022 2/2 are co-villagers. The injuries are simple in nature. Though, there is allegation of firing against these two petitioners, but no one sustained any fire-arm injury. Other similarly situated coaccused persons have already been granted bail, vide order dated 11.07.2022 passed in Cr.Misc. No. 61329 of 2021. Petitioners have got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Biharsharif / concerned court in connection with Rahui P.S. Case No. 88 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
