JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 14-12-2016 The present application has been filed for modification of order dated 10.03.2016 passed in Cr. Misc. No. 47177 of 2015.

Learned counsel for the petitioner confines his prayer only to the extent of extending the period of surrender. The petitioner is an Army personnel and could not get leave and hence, he could not surrender in time.

On the grounds mentioned in the modification application, the period of surrender is extended by three weeks from the date of receipt/production of a copy of this order in connection with Complaint Case No. 215C of 2013 pending in the court of learned Sub-divisional Judicial Magistrate, Bhojpur at

Patna High Court Cr.Misc. No.53497 of 2016 (2) dt.14-12-2016 2/2 Ara. Let the date of appearance of both sides be also extended from 18th April, 2016 to 4th January, 2017. The rest conditions stipulated in the order dated 10.03.2016 will remain the same. The order dated 10.03.2016 stands modified to the extent indicated above.

Accordingly, this modification application is disposed of.
