Petitioners apprehend their arrest in connection with Dhamdaha P.S. Case No. 251 of 2017, registered for the offences punishable under Sections 323, 341, 354, 504, 384/34 and 307 of the Indian Penal Code.

Allegation against the petitioners is of assault to the informant and her son and of demanding extortion. Submission of learned counsel for the petitioners is that there is case and counter case between the parties and though injuries were found to be grievous but no specific allegation is attributed against any of the petitioners and there is land dispute

Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail on the ground that two injuries were found to be grievous in nature on the person of informant Leela Devi.

Having heard both sides and in the facts and circumstances and considering the fact that there is no specific allegation against the petitioners, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea, in connection with Dhamdaha P.S. Case No. 251 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immovable properties within the jurisdiction of court concerned.
