JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 17-08-2016 After having heard the parties and taking into consideration the averments made in the supplementary show cause filed on behalf of the opposite party no.2 as also the reasoned order dated 20.05.2016 (Annexure-A) passed by the Joint Secretary of the Department of Health, Government of Bihar, Patna, this Court is satisfied that the order of the Writ Court dated 05.09.2014 passed in CWJC No.4834 of 2014 has been complied with, and no case for initiating a proceeding of contempt against the opposite parties herein is made out.

Patna High Court MJC No.1718 of 2015 (3) dt.17-08-2016 Accordingly, the present MJC application is dismissed.

However, the petitioner, if so advised, shall be at liberty to challenge the validity and correctness of the aforesaid order dated 20.05.2016 (Annexure-A) in an appropriate proceeding before an appropriate forum/court. (Birendra Prasad Verma, J) Arvind/- U
