JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-06-2018 Heard the parties. The petitioners seek anticipatory bail in connection with Asthawan P.S. Case No. 54 of 2018, registered for offences punishable under Section 379 of the Indian Penal Code and Section 4/40 of Bihar Minor Mineral Concession Rules, 1972 and Section 8(d) of Bihar Minerals (Prevention of Illegal Mining Transportation & storage) Rules, 2003.
The allegation against the petitioners is that the tractor loaded with sand intercepted by the police along with other tractors.
Submission of the learned counsel for the petitioners is that the petitioner No. 1 is owner and petitioner No. 2 is the
Patna High Court Cr.Misc. No.29788 of 2018 (4) dt.26-06-2018 2/2 driver of tractor and they have no criminal antecedents and they are ready to obey the conditions imposed upon them. t Heard learned A.P.P. also. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, surrender within a period of six weeks from the receipt of the order and on released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Nalanda at Biharsharif, in connection with Asthawan P.S. Case No. 54 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that, in future if they involved in such type of cases their bail bond shall be cancelled.
