JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-08-2019 This modification application has been filed for modification of order dated 26.07.2019 passed in Cr. Misc. No. 31401 of 2019, by which, the petitioner has been granted the privilege of anticipatory bail.

Submission of learned counsel for the petitioner that due inadvertent mistake, the address of the petitioner has wrongly been mentioned in the petition for bail as resident of village - Laxmipur, Police Station - Pirpainty, District - Bhagalpur and due to which, the same has also been recorded in the order dated 26.07.2019, however, the correct address of the petitioner is Village - Nilkanth Nagar, Police Station -

Patna High Court CR. MISC. No.54250 of 2019(2) dt.28-08-2019 2/2 Ishakchak and thus prayed for modification of order dated 05.07.2019 passed in Cr. Misc. No. 22179 of 2019 and also for extension of time to surrender in the court below. Heard learned APP also.

Having heard both sides, considering the fact and circumstances, order dated 05.07.2019 passed in Cr. Misc. No. 22179 of 2019 is modified to the extent that let the address of petitioner be read as resident of Village - Nilkanth Nagar, Police Station - Ishakchak and further two weeks' time from the date of receipt of order in the court below, is allowed to the petitioner to surrender in the court below.

Accordingly, this modification application is allowed. Let a copy of this order be communicated to the concerned court below forthwith.
