The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 498A, 494, 341, 323, 504, 506, 34 of the Indian Penal Code. As per prosecution case, the allegation against the FIR named accused persons including the petitioner is that they used to torture the informant's daughter and one day the petitioner ousted her from the house. It is further alleged that the petitioner is also going to solemnize second marriage Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any wrong
Patna High Court CR. MISC. No.59553 of 2023(2) dt.08-09-2023 2/2 offence. The petitioner is husband of the informant's daughter and due to family dispute he has falsely been implicated in this case. He has got no criminal antecedent. It is further submitted that the petitioner is also ready to keep his wife with proper honour and dignity. Moreover, he is languishing in judicial custody since 11.06.2023.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Tankuppa P.S. Case No. 18 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, First Class, Gaya. (Sunil Kumar Panwar, J) subham/- U T
