Petitioner apprehends his arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition & Excise Act.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation in the confessional statement of co-accused, who was apprehended on the spot with illicit liquor. No incriminating article has been recovered from the possession of the petitioner. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and clean antecedent

Patna High Court CR. MISC. No.68541 of 2021(2) dt.26-05-2022 2/2 of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Sitamarhi in connection with Bajpatti PS case No. 77/2021, subject to conditions laid down u/s 438(2) of the Cr.
