This is an appeal under Section 14(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as the "SC/ST Act") against the refusal of prayer for anticipatory bail vide order dated 01.02.2018 passed by the learned Special Judge S.C./S.T., Gaya in A.B.P. No.23 of 2018, arising out of Belaganj Police Station Case No.148 of 2017 registered under Sections 341, 323, 383, 384, 387, 504, 506/34 of the Indian Penal Code and Sections 3 (i)(r)(a) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. The informant is a carrier of Gas agency. Allegation is that the appellant and others forcefully took away the gas cylinder from the vehicle and snatched his money. In the past also the appellant and others had committed such occurrence.
Patna High Court CR. APP (SJ) No.1742 of 2018 dt.10-09-2018 2/2 Learned counsel for the State submits that the case diary would reveal that four eyewitnesses have supported the aforesaid allegation.
After hearing the parties and considering the nature of allegation, I am no inclined to enlarge the appellant, above named on anticipatory bail. Hence, this appeal against the refusal of prayer for anticipatory bail stands dismissed. The appellant may surrender and pray for regular bail.
