The petitioner apprehends his arrest in S.T. (Excise) Case No.832 of 2018, arising out of Supaul Nadi P.S. Case No.41 of 2018, registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The police on secret information raided the house of Dhanpat Mandal and recovered 4 litres of Nepali country made liquor from his house. Dhanpat Mandal is said to have disclosed that his son Jaikrishna Mandal, the petitioner had brought liquor after purchasing it from Pradeep Yadav and on such disclosure made by the father, the petitioner, son of Dhanpat Mandal has been made accused.

Learned counsel for the petitioner submits that there is no material to show that the petitioner had brought the liquor and

Patna High Court CR. MISC. No.58558 of 2019(2) dt.23-09-2019 2/2 kept in his house. The father of the petitioner has been arrested on the spot and he has already been granted bail. Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions JudgeII-cum-Special Judge (Excise), Supaul in connection with S.T. (Excise) Case No.832 of 2018, arising out of Supaul Nadi P.S. Case No.41 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
