The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 75.24 litres of liquor was recovered from the water plant owned by the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession and he has been falsely implicated in the case only on the ground of being the owner of the water plant in question. He is in custody since 09.09.2021 and has no antecedent under the Bihar Prohibition and Excise Act, 2016. Chargesheet has been

Having heard learned counsel for the parties and taking into consideration the petitioner not having any antecedent under the Bihar Prohibition and Excise Act, 2016, period in custody being eight months and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Samastipur Muffasil P.S. Case No. 414 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-II-cum-Special Judge (Excise), Samastipur.
