In this case, the petitioner is seeking anticipatory bail in connection with Assaon P.S. Case No. 69 of 2013, registered for the offence punishable under Sections 304B and 120B of the Indian Penal Code.

As per the First Information Report, the victim was married with the petitioner and she gave birth of a child. Allegedly, the family members of the victim were demanding one motorcycle and Rs. 1,00,000/-. It is admitted fact that the petitioner who is husband of the victim was not in India at the time of occurrence and after the death of the victim he returned to India.

No.25964 of 2017 (3) dt.17-08-2017 2/2 Looking to the aforesaid facts, let the petitioner-Mahesh Kumar @ Mahesh Sah be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Assaon P.S. Case No. 69 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
