The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 468, 471 and 120B of the Indian Penal Code.
The prosecution case as per the written report of Wasim Ahmad, Centre Superintendent, G.D. College, Begusarai dated 17.03.2015submitted to the Station House Officer, Begusarai Town P.S., is to the effect that one Abhinandan Kumar was appeared at Matric examination in place of the petitioner.
It is submitted by learned counsel for the petitioner that the petitioner was not aware about Abhinandan
Patna High Court Cr.Misc. No.39798 of 2018 (2) dt.10-07-2018 Kumar appearing in his place and even assuming the accusation to be true, at best, a case under Section 419 of the Indian Penal Code is made out which is bailable. It is further submitted that non-grant of bail to the petitioner will jeopardize his career. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Considering the thrust of accusation against Abhinandan Kumar and the statement being made in paragraph 3 of the petition that the petitioner is not having criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 140 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
