JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-02-2025 Heard learned senior counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant.
2. The petitioner seeks bail in a case registered for offence under Sections 341, 323, 307, 354, 379, 504, 34 of the Indian Penal Code.
3. The petitioner is alleged to have assaulted on the head of son of informant by mean of iron rod causing him grievous injury.
4. Learned senior counsel for the petitioner submits that the parties are co-villagers and there is land dispute between them. Case and counter case. He further submits that in the alleged occurrence, petitioner also sustained grievous injury.
Patna High Court CR. MISC. No.60981 of 2024(4) dt.21-02-2025 2/2 Petitioner has got clean antecedent and is in custody since 01.07.2024. Chargesheet has been submitted.
5. Learned A.P.P. for the State and learned counsel for the informant vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with G.R. Case No. 3280 of 2023, arising out of Muffasil P.S. Case No. 396 of 2023.
