ANJANA MISHRA ORAL ORDER 09-11-2015 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. Petitioner No.2 Eliash Alam @ Elyash Alam is apprehending his arrest in connection with Dhaka P.S. Case No.56 of 2015 for allegedly having committed the offence under Sections 147, 148, 149, 323, 324, 325, 307, 436, 379 and 448 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that there is general allegation against this petitioner and there is case and counter case between the parties with regard to blockage of road by the informant. Learned counsel for the petitioner submits that vide order dated 4.8.2015 in Cr.Misc. No.30221 of

Patna High Court Cr.Misc. No.32879 of 2015 (4) dt.09-11-2015 2/2 2015, this Court has been pleased to extend the privilege of anticipatory bail to the co-accused in connection with the same case.

Considering the aforementioned facts and circumstances and the materials which have come in the case diary and that petitioner no.2 has no criminal antecedents, let Petitioner No.2 Eliash Alam @ Elyash Alam, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sikarahana at Motihari, East Champaran, in connection with Dhaka P.S. Case No.56 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
