The petitioner apprehends arrest in Falka (Pothia) P.S. Case No. 03 of 2014 instituted for the offence under Sections 364 of the IPC.

Learned counsel for the petitioner submits that he is not named in the written report. His name has come in confessional statement of co-accused in paragraph 55 of the case diary.

Learned APP for the State, after looking into the case diary submits that process has already been issued under Section 82 Cr.P.C. against the petitioner and he has been absconding as mentioned in case diary.

Keeping in view, that process has already been issued

Patna High Court Cr.Misc. No.14490 of 2018(4) dt.15-05-2018 2/2 against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, this anticipatory bail petition stands rejected.

The petitioner is directed to surrender in the court below within six weeks from today and seek regular bail which will be considered by the court below in accordance with law, without being prejudiced by this order.
