1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 504, 506 and 120(B)/34 of the Indian Penal Code as well as Section 27 of the Arms Act.
3. Learned counsel for the petitioner submits that petitioner is in custody since 31.03.2024. It is further submitted that Sarswati Devi had moved this Court seeking anticipatory bail by filing Cr. Misc. No. 44515 of 2024 and the same was allowed by an order dated 26.06.2024. It is next submitted that while considering the prayer for anticipatory bail of Sarswati Devi the case was considered on merits and in detail and from perusal of the order dated 26.06.2024 in Cr. Misc. No. 44515 of
Patna High Court CR. MISC. No.63743 of 2024(2) dt.13-12-2024 2/2 2024, it would manifest that specific allegation of firing was against Ravindra Yadav causing injury to the father of the informant who subsequently died and against this petitioner, it was alleged that he also fired but missed.
4. Learned A.P.P. for the State and the learned counsel appearing on behalf of the informant opposed the prayer for regular bail of the petitioner.
5. Considering the submission that petitioner is not alleged to be the assailant of the deceased, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Deepnagar P.S. Case No. 40 of 2024.
