JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Laukaha P.S. Case No. 152 of 2017, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code Section 30 (a) of the Bihar Excise Prohibition Act, 2016.

Recovery of 29 bottles of Nepali wine was recovered from the co-accused Rohit Gurmit, who confessed that he was going to supply the same to the petitioner.

Submission of the learned counsel for the petitioner is that he has no criminal antecedent and nothing incriminating has been recovered from his physical possession. On disclosure of co-accused he made accused in this case.

Heard learned A.P.P. also.

No.55112 of 2019(2) dt.02-09-2019 2/2 In view of the above facts and circumstances, let petitioner, above named in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the learned A.D.J.-II-Cum- Special Judge (Excise) Madhubani, in connection with Laukaha P.S. Case No.152 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
