JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 05-08-2015 The present application has been filed for modification of order dated 10.05.2012 passed in Cr. Misc. No. 17421 of 2012 for extending the period of surrender, whereby the petitioners were granted anticipatory bail in connection with Complaint Case No. 1165 of 2010 wherein process was directed to be issued after cognizance being taken for the offences punishable under Section 304B of the IPC.
Since the initial order was passed on 10.05.2012, this Court is not inclined to entertain the present modification application.
Let the learned court below consider the prayer for regular bail of the petitioners keeping in view of the fact
Patna High Court Cr.Misc. No.34732 of 2015 (02) dt.05-08-2015 2/2 that on merits the petitioners were granted anticipatory bail, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 1165 of 2010 pending in the court of learned Chief Judicial Magistrate, Kaimur at Bhabua.
Accordingly, this modification application is disposed of.
