JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-08-2019 This modification application has been filed for modification of order dated 15.07.2019 passed in Cr. Misc. No. 19753 of 2019, by which, the prayer for anticipatory bail of the petitioner was disposed of with direction to the petitioner to surrender on 24.07.2019 with the condition that if the petitioner is ready to pay Rs. 20,000/- per month to opposite party no. 2 for herself and for her daughter, he will be released on bail. However, it has been submitted by learned counsel for the petitioner that since the monthly income of the petitioner is only Rs. 18,000/-, it is not possible for him to pay the amount to opposite party no. 2 as directed by this Court and thus prayed for modification of order dated 15.07.2019 passed in Cr. Misc.

Heard learned APP also.
Having heard both sides, considering the fact that the order has been passed in presence of the parties including opposite party no. 2, and at that time no objection was raised, as such, I am not inclined to modify the order dated 15.07.2019 passed in Cr. Misc. No. 19753 of 2019.
Accordingly, this modification application stands dismissed.
