2. The learned counsel for the petitioner has submitted that the earlier regular bail petition of the petitioner was rejected by this Court vide order dated 03.09.2024 in Cr. Misc. No. 5711 of 2024 but the petitioner is renewing his prayer for bail on the ground of his prolonged custody and snail pace of the trial. He has further submitted that other co-accused persons have been granted bail.

3. A report regarding stage of the trial was called for and is available on record. The report shows that the charges were framed on 27.05.2024 and till date, only one witness out of seven charge-sheeted witnesses has been examined. The one witness who has been examined has been declared hostile. 4.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned ADJ-VIII, Patna City in connection with khusrupur P.S. Case No. 184 of 2023,

Patna High Court CR. MISC. No.57409 of 2025(3) dt.10-10-2025 2/2 subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available on each and every date till conclusion of the trial.

(ii) The petitioner will appear on each and every date fixed by the court and if he fails to do so on two consecutive dates, unless he is prevented by extremely adverse circumstances, the learned court below will be at liberty to cancel the bail bond of the petitioner.

(iii) The petitioner will appear in the court on each and every date fixed by the trial court till framing of charges. (iv) Before accepting the bail bond, the criminal antecedent of the petitioner shall be verified and if, it is found that he is involved in any other case except the case(s), mentioned in paragraph no. 3 of the bail petition, his bail bond shall not be accepted.
