The petitioner is languishing in custody in a case registered for the offences punishable under Section 498(A) of the Indian Penal Code.

It is a case of cruelty for non-fulfillment of dowry demand.

It is submitted by learned counsel for the petitioner that petitioner is husband of the complainant and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The complainant is a quarrelsome lady and she herself

Patna High Court CR. MISC. No.59528 of 2022(2) dt.03-02-2023 2/2 does not want to live with the petitioner. Moreover, the petitioner has already filed Divorce Suit being Matrimonial Case No. 581 of 2020 and thereafter the present complaint has been filed against the petitioner to put pressure upon the petitioner. The petitioner is languishing in custody since 25.07.2022.

Learned counsel appearing on behalf of the complainant has stated that torture was inflicted upon the complainant.

In the facts and circumstance of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Vaishali at Hajipur in connection with Complaint Case No. 56 of 2021.
