Petitioner was arrested while he assembled along with others to make preparation for committing dacoity and allegedly, one country made loaded katta was recovered from his conscious possession for which petitioner remains in jail custody for near about five months.

Para 3 of the petition reveals that prior to institution of the present case, one Teghra P.S. case no. 01/2013 for the offence punishable under section 366A of the Indian Penal Code had been registered against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate,
